Real Estate and Property Law

Buying, selling, leasing, or inheriting property is one of the biggest decisions you’ll make. Recososa Law Firm helps you check the title, document the deal properly, and protect your rights, so your property doesn’t turn into a lawsuit later.

How we help

  • Due diligence before you buy: title verification with the Registry of Deeds, tax declarations, encumbrances, and occupants;
  • Deeds of sale, contracts to sell, and condominium purchases;
  • Title transfer: capital gains tax, documentary stamp tax, transfer tax, and registration;
  • Leases for homes, offices, and commercial spaces;
  • Estate settlement: extrajudicial settlement, partition among heirs, and estate tax;
  • Property disputes: reformation of deeds, quieting of title, cancellation of title, and ejectment.

Frequently asked questions

What should I check before buying land?

At a minimum: get a certified true copy of the title from the Registry of Deeds, check the tax declaration and real property tax payments, inspect the property in person, and ask about anyone occupying it. Visible occupants can affect your claim to good faith.

What if my deed of sale has the wrong lot number?

The sale may still be valid. The Supreme Court allowed a Cebu City deed with the wrong lot number to be corrected because the parties’ true agreement was clear.
